Document Authentication and Legalization
Procedures & Fees


Quite often, American citizens and business persons require that certain documents be "legalized" or "authenticated" so that they can be used in Ukraine. The procedures to be followed depend on the nature of the documents and are similar to the requirements of all other governments throughout the world.

Notarization

If the document is in the Ukrainian language and requires merely notarization, then it may be signed by the signatory person before the Consul of Ukraine at the Consulate Office who will thereafter notarize it (see here).


Authentication by the US Department of State

All documents issued by American governmental entities, or which are business documents or documents that have been previously notarized in accordance with the procedures of the various States must be legalized in accordance with the US Rules and Regulations for Authentication of Documents by the Authentication's Office (FMSS/GS/AUTH) of the US Department of State (518 23rd Street, N.W., State Annex 1, Washington, D.C. 20520; Tel: 202-647-5002, 1 800-688-9889 (Option #6). After being legalized, they may be submitted to the Ukrainian Consulate for "authentication".


 The Consulate General of Ukraine will legalize only those U.S. documents, each of which has been duly authenticated by the appropriate U.S. authorities.

The Consulate General of Ukraine in New York can legalize only the documents generated or recorded in the states of Connecticut, Maine, Massachusetts, New Hampshire, New Jersey, New York, Pennsylvania, Rhode Island or Vermont:

a)      American business documents, or documents relating to the adoption of children from Ukraine, each of which has been duly authenticated by the U.S. Department of State,

b)      All other documents each of which have been certified by the Secretary of State of the respective State.

Beginning on October 1, 2002, any above-mentioned document, due to be legalized by the Consulate General of Ukraine is required to be authenticated by the U.S. Department of State, irrespective to the nature of such a document.

2.                   A photocopy of the entire original must also accompany each document Submitted to Consulate General of Ukraine for legalization.

When submitting and documents heaving any pages with overlapping attachments, you must provide a photocopy of each such page both with and without the attachment. In doing so, care must be taken not to remove any staples. Photocopies of multi-page documents must be in exact sequential order as the original, collated and stapled, and attached to the original document with a clip.

 

Fee Structure for Legalization of Documents

3.                  The Consulate General of Ukraine accepts processing fees only in the form of money order made payable to the “Consulate General of Ukraine in New York.

4.                  If the documents are to be returned by mail or courier service, the Consulate General of Ukraine must be provided with a pre-paid self-addressed envelope. Any mail service is acceptable except DHL. The FedEx, UPS, Airborn Express, Express Mail are preferable.

The Consulate General of Ukraine disclaims any responsibility for any mail that is lost, damaged, misdirected or delivered late.

5.                  The documents, which you are intended to submit for legalization, should be delivered to the Consulate General of Ukraine on its business hours.

The processing time is nine business days. At the specific request of a submitting party for expedite service documents will be legalized at the same (up to three documents) or next day.


Processing time

The processing time for legalization of documents is nine business days not counting the business day of its receipt by the Consulate. Please also be advised that documents received on Saturday, Sunday or a legal Ukrainian or American holiday are considered received on the next business day.

Expedited Service: At the specific request of the submitting party, documents will be legalized on the next business day. For expedited service the consular fees are doubled.

To better serve you, we request that you do not call regarding your documents legalization status, as that may interrupt our processing.

If applying by mail, a return __self-addressed prepaid express envelope is required. When there is no enclosed such envelope, the documents will be kept at the Consulate, without charge, for personal pick-up, or returned by regular mail.

Instruction for the legalization of documents by the Ministry of Foreign Affairs of Ukraine (dated the February 2000)

1. The Consular Department of the Ministry of Foreign Affairs of Ukraine pursuant to the Vienna Convention on Diplomatic Relations (1963), the Consular Statute of Ukraine, approved by Decree of the President of Ukraine ¹127/94, conducts legalization of documents issued by official bodies of Ukraine directed for circulation abroad. Since Ukraine is not a Party to the Hague Convention abolishing the Requirement of Legalization for Foreign Public Documents, the chain legalization procedure is in use on the territory of Ukraine.

2. The Consular Department legalizes the following documents:

  • original public documents of new Ukrainian sample, issued by authorities registering acts of civil state, certified by regional Department of the Ministry of Justice in the region (oblast') of their issuance; Department of Justice in the Autonomous Republic of the Crimea; Municipal Departments of Justice in Kyiv and Sevastopol; Central and Livoberezhnyi Authorities registering acts of civil state.
  • original documents of education (diplomas, certificates of degree etc.) of international sample shall be legalized if the application letter of the Higher Educational Institution issuing such document is provided. This letter should be certified by the Ministry supervising such Institution.
  • copies, translations and other documents, certified or issued by State notaries. These documents should be certified by the Ministry of Justice of Ukraine.

Upon legalization by the Consular Department, public documents should be certified by diplomatic mission or consular post of the State wherein they will be used.

3. The Consular Department shall not legalize documents, executed in a foreign State. Such documents should be legalized by Ukrainian Consular Post in a State from which such documents emanate. In case there is no Ukrainian Consulate in such a State, foreign documents could be legalized by the Consular Department of the Ministry of Foreign Affairs of Ukraine after being certified by the Ministry of Foreign Affairs of the State (or other body authorized to certify the documents designated for use abroad) from which they emanate and by a Consular Post of such State, representing this State in Ukraine.

4. Documents belonging to natural persons (citizens) shall be accepted for legalization only if a passport or any other document identifying person is provided; as far as the legalization of documents certifying marital status is concerned, a national passport is required. When handing in documents for legalization belonging to or written out for another person, an applicant should present notarial letter of attorney issued by the owner of these documents. A letter of attorney, issued by competent bodies of foreign State should be certified in Ukrainian Consulate in this State (see appendix ¹ ).

5. Documents of legal entities shall be accepted if the application letter on a blank with a requisite and a seal of the enterprise. Such application letter must contain: a list of documents, purpose for legalization of documents, information about a person authorized to hand in documents. Where necessary the Consular Department may require other (additional) documents to ascertain the facts indicated in documents subject to legalization.

6. All citizens handing in their documents for consular legalization shall fill in an application form.

7. Consular fees for legalization shall be paid directly in the bank office located in the Ministry of Foreign Affairs, upon documents subjects to legalization have been handed in:

  • 8 Hrn for documents of citizens of Ukraine;
  • 85 Hrn for documents of legal entities and organizations related to their activity;
  • 17 Hrn for documents of non-citizens of Ukraine.

8. Legalization procedure takes 1 day an Documents, having been accepted for legalization, can be collected starting from the next day. Documents legalized on urgent procedure can be collected the same day. In this case the double consular tariff is to be paid

10. Consulting concerning legalization could be provided by officers of the Consular Department of the Ministry of Foreign Affairs in the rooms ¹ 1, 2, 3. The Consular Department of the Ministry of Foreign Affairs is not responsible for the validity of any information received from other sources.

11. The rules stated in this Instruction may be subject to change.
